Separate law, enrollment and contract requirements
Requirements should be checked whether you operate one wheelchair van, a small stretcher fleet or a large regional paratransit company. Fleet growth, new states and different passenger-assistance services can change the review even when the business name stays the same.

Federal Medicaid transportation assurance
42 CFR 431.53 requires a state Medicaid plan to assure necessary transportation to and from providers and explain how it will do so. That provision does not specify a nationwide dollar amount for an operator’s auto or general liability policy. Source: eCFR, 42 CFR 431.53. Separate the state’s transportation-benefit obligation from the insurance, driver, vehicle and enrollment conditions imposed on your business.
California: enrollment and service classification
Medi-Cal NEMT and NMT are distinct service categories. Identify the vehicle mode and applicable DHCS enrollment pathway before compiling permits and insurance evidence. CPUC authority, DMV requirements and local permissions must be checked against the actual operation; avoid a blanket statement that every NEMT provider needs the same TCP permit or filing.
Texas: workers’ compensation is not a four-person rule
Texas allows private employers to choose workers’ compensation coverage; non-subscribers have notification and reporting duties. Source: Texas DWC, Employer E-File online reporting. A Medicaid, broker or facility agreement may independently require the coverage. Review the applicable HHSC or health-plan program documents for the transportation contract instead of treating a generic $1 million limit as a verified universal HHSC rule.
Florida: employee count and entity structure matter
Florida requires non-construction employers with four or more employees to carry workers’ compensation, with specified owners included and exemptions affecting the count. Source: Florida Division of Workers’ Compensation, Coverage Requirements. For NEMT work, separately confirm AHCA enrollment, the health plan’s current transportation terms and vehicle requirements. An advertised fleet premium or common contract limit is not proof of compliance.
New York: a provider-support letter can be required
eMedNY’s Option 2 non-medical transportation enrollment instructions require a MAS Letter of Support and return applications submitted after April 15, 2024 without it. This is an enrollment condition for the identified applicant category, not an insurance endorsement or a universal rule for every medical transportation license.
Arizona, Nevada and other state expansions
Collect the state program, payer contract, service category and transportation-authority documents for each proposed territory. Confirm any local vehicle permits and whether interstate work changes authority or filing requirements. Do not use a California enrollment approval, a Texas employment assumption or another operator’s certificate as a substitute for the rules governing the new operation.
Which insurance lines belong in the comparison?
Check commercial auto liability, general liability, professional liability, SAM, workers’ compensation, employer’s liability and any umbrella or excess layer. Auto physical damage and conversion equipment protect different interests from liability. Hired/non-owned auto, uninsured/underinsured motorists, medical payments, cyber, property and equipment can also be relevant. Values such as $1 million auto or $1 million/$2 million GL are examples to compare with the actual exhibit, not nationally applicable legal minimums.
Vehicle accessibility, inspection and driver standards
Gather the applicable accessibility, inspection, lift-maintenance and restraint-system requirements for each vehicle class. Confirm driver licensing, MVR review, screening, training, medical certification and testing requirements for the actual program and duties. ADA rules and equipment standards should not be collapsed into an assertion that a single wheelchair product standard governs every van. Keep documentation current and distinguish a buyer’s training requirement from a universal federal rule.

Questions about separate law, enrollment and contract requirements
Is there one federal NEMT auto liability minimum?
The transportation-assurance provision in 42 CFR 431.53 does not set one. Determine applicable vehicle and operating-authority law, then compare the payer and broker contract requirements.
Must every California NEMT operator obtain a TCP permit?
Do not assume the same permit applies to every service. Confirm the vehicle and operating classification with the responsible authority and distinguish that approval from Medi-Cal enrollment.
Can I transport Medicaid members while enrollment or insurance is pending?
Do not treat a pending application as approval. Confirm required coverage, authority, enrollment and buyer authorization before accepting the work.
Does meeting a state minimum satisfy a hospital contract?
A hospital can ask for different or higher insurance terms. Review the full exhibit, including endorsements and the coverage lines to which each limit applies.
